Insights Product Security and Telecommunications Infrastructure Act 2022 (Commencement No 2) Regulations 2023 made

The Product Security and Telecommunications Infrastructure Act 2022 was enacted on 6 December 2022. It governs the security of internet-connectable products and products capable of connecting to such products. The Act also covers electronic communications infrastructure.

The following provisions came into force on 6 December 2022:

  • section 27
  • sections 76 to 78; and
  • powers to make regulations.

The remaining provisions come into force in accordance with regulations made by the Secretary of State. Accordingly, on 2 February 2023, the Product Security and Telecommunications Infrastructure Act 2022 (Commencement No 1) Regulations 2023 were made, which brought the following provisions of the 2022 Act into force:

  • section 57 (rights under the Electronic Communications Code to share apparatus);
  • section 60 (power to fly lines from apparatus kept by another operator); and
  • section 75 (meaning of “the Electronic Communications Code”).

The same Regulations also provided that the following provisions of the 2022 Act would come into force on 17 April 2023:

  • section 58 (upgrading and sharing of apparatus: subsisting agreements); and
  • section 59 (upgrading and sharing of apparatus installed before 29 December 2003).

On 25 April 2023, the Product Security and Telecommunications Infrastructure Act 2022 (Commencement No 2) Regulations 2023 were made. These Regulations have brought into force s 66 (refusal of application for code rights on grounds of national security etc) in Part Two of the 2022 Act (Telecommunications Infrastructure).

These same Regulations also state that the rest of Part 1 of the 2022 Act (i.e. the majority) will come into force on 29 April 2024. From that date, businesses involved in the supply chains of these connectable products will need to be compliant with this legislative framework.

In preparation for this, the Government has also now published, in draft, the Product Security and Telecommunications Infrastructure (Security Requirements for Relevant Connectable Products) Regulations 2023, which it says it will introduce to Parliament when Parliamentary time allows.
