Introduced by the Data Protection Act 2018, the code will provide guidance on the privacy standards that the ICO will expect organisations to adopt where they are offering online services and apps that children are likely to access and which will process their data.

The Code will further the concept of data protection by design, which is a key feature of the new Data Protection Act and the General Data Protection Regulation (GDPR).

Once the Code has been published, the Commissioner will be required to take account of any provisions of the Code she considers to be relevant when exercising her regulatory functions.  The courts and tribunals will also be required to take account of any provisions they consider to be relevant in proceedings brought before them.  The Code may be submitted as evidence in court proceedings.

The ICO is asking for views from providers of online services, child development experts, children’s advocacy services, academics and others with an interest in what the Code should say.
