CAP and BCAP are consulting on changes to their rules on offence, rolling papers and sanitary protection products.

The regulators explain that the last wholesale review of the CAP and BCAP Codes was completed in 2010, before the Equality Act 2010 came into force. CAP and BCAP therefore considered that in light of the public sector equality duty contained in the Act, to which CAP and BCAP consider they are subject, it would be appropriate to examine whether the Codes are consistent in the protections they provide to those sharing any of the protected characteristics included in the Act.

That analysis showed that certain changes to the Codes, while not necessarily required by law, would strengthen the protections they provide. The relevant provisions of the Act and the rationale for CAP and BCAP’s decision to consult on changes to its rules are set out in CAP and BCAP’s consultation documents.
