An ICO spokesperson said: “The ICO is considering the judgment from the European Court of Justice in the Schrems II case and its impact on international data transfers, which are vital for the global economy. We stand ready to support UK organisations and will be working with UK Government and international agencies to ensure that global data flows may continue and that people’s personal data is protected.”

The ICO’s advice on its International transfers guidance page is that while it is reviewing its Privacy Shield and Standard Contractual Clauses (SCCs) guidance following the Schrems II judgment, organisations currently using the Privacy Shield should continue to do so until new guidance becomes available. However, organisations should not start to use the Privacy Shield during this period. To read the statement on the ICO website, click here.
