The Competition and Markets Authority (CMA) has published summary guidance for organisations on how to comply with the new price transparency rules under the Digital Markets, Competition and Consumers Act 2024 (DMCCA).
The summary guidance is considerably more accessible and user-friendly than the more comprehensive guidance that was released by the CMA towards the end of last year (see here). That said, it comes with the obvious health warning that it should be treated as a helpful initial resource for organisations, rather than as detailed, authoritative advice about the operation of the DMCCA’s price transparency provisions.
Key aspects of the new rules are covered, including everything from having to set out the total price of the product up front inclusive of any ‘unavoidable or mandatory’ charges, providing consumers with the information needed to calculate the total price where necessary, and how to treat delivery and per-transaction charges.
The summary guidance also includes helpful practical examples of how the rules operate in different scenarios, alongside mock-ups showing how information might be presented on a website. In addition, the CMA provides a helpful flowchart that helps organisations determine what information must be included in the price stated in an invitation to purchase, as follows:
