Wiggin’s IP team have had the pleasure of advising the Jersey Financial Services Commission on the reform of trade mark law in the Bailiwick of Jersey.

The Trade Marks (Jersey) Law 2026 will come into force on 1 August 2026 and represents the culmination of a major project to update and modernise Jersey’s trade mark system. The new law is closely based on the UK’s Trade Mark Act 1994 (as amended).

When the Law comes into force, Jersey will become a primary trade mark registration jurisdiction and will also become an independent designation under the Madrid Protocol. Previously, it was necessary to first obtain trade mark protection in the UK and then extend protection to Jersey, or to rely on a UK designation of an international registration which also covered Jersey.

Brand owners will need to factor these changes into their trade mark filing and enforcement strategies going forwards.
