The government has published its anticipated draft statutory instruments on land-based casinos, with new regulations stated to come into effect on 22 July 2025.

The Casinos (Gaming Machines and Mandatory Conditions) Regulations were laid before Parliament in draft on 12 May 2025 and form part of the expected regulatory changes following the DCMS consultation on measures relating to the land-based gambling sector. The government’s consultation response was published on 16 May 2024 and can be found here.

As originally intended, the following changes for casinos licensed under the Gaming Act 1968 have been incorporated into the drafts:

  1. Increase the maximum number of Category B gaming machines to 80, provided they meet the size requirements of a Small 2005 Act casino[1] (see the Annex B statutory instrument);
  2. Permit smaller 1968 Act casinos[2] more than 20 Machines (on a pro-rate commensurate to their size) ((Draft Regulation 4);
  3. Permit betting in all casinos ((Draft Regulation 4);
  4. Reduce the minimum table gaming area requirement (from 500sqm to 250 sqm) for Small 2005 Act casinos (Draft Regulation 4); and
  5. Introduce a 5:1 machine to table ratio for both 1968 Act casinos and Small 2005 Act casinos (Draft Regulation 3).

The Annex C statutory instrument enables “the holder of a converted casino premises licence who wants to utilise the new entitlements to apply to the relevant licensing authority to vary that licence so the casino plan can show the location and extent of any part of the premises which will be a table gaming area.” The current regulations do not require converted casino premises to do this presently.

The drafts also provide for a review of the regulatory provisions in the new regulations to be carried out by the Secretary of State “from time to time,” with a report setting out the conclusions published within five years of the enforcement date (Draft Regulation 5).

Note that these statutory instruments are in draft. As such they may be subject to change prior to their 22 July implementation date.
