HomeInsightsCMA investigating whether online gambling companies “are treating their customers fairly”

Hot on the heels of its recent enforcement action against operators for breaching consumer law in the context of promotional activity, the Competition and Markets Authority has launched a further round of enforcement actions against a number of online operators, concerned they may “place unfair obstacles in the way of people withdrawing their money (whether as part of a promotion or not)”.

This enforcement action (at present against an unknown number of operators) is not a surprise as the CMA had been citing concerns in this areas for some time.

Issues raised include:

  • Daily, weekly or monthly limits on withdrawing funds that appear unreasonably low;
  • potentially arbitrary short deadlines on the time customers have to verify their identity as a condition of withdrawing funds, sometimes providing for forfeiture of consumer’s funds if missed; and
  • dormancy terms that allow firms to confiscate funds or impose apparently excessive charges after a certain period of inactivity.
