"The Draft Defamation Bill is certainly a step in the right direction. In particular, the extension of the honest opinion defence is a real reinstatement of freedom of speech in this country and the change to the single publication rule means that publishers no longer live in fear of old stories resurrecting years after the protagonists moved on. However, the Bill does little to address the issues that really give rise to the notorious costs of libel litigation and more than anything deny parties access to justice. Wiggin will be making submissions to the Government and hope that further changes can be introduced during the consultation period.
